​Shipping and Delivery

Dr.Cushion uses the standard delivery service provided by a third-party logistics company, and you can track your order on the logistics company's website.
We offer free shipping and returns at no cost within the United States (excluding Alaska, Hawaii, Puerto Rico and other US territories), while pick-up service is excluded. 

​Risk-free for 30 nights

Only the following products are covered by a 30-night Risk-free Trial Period that begins the day your product is delivered:

  • the original Dr.Cushion smart sleeping pad(s) and controller(s) purchased and delivered on the original date;
  • the original Dr.Cushion cooler(s) purchased additionally and delivered on the original date.

If you are not completely satisfied after sleeping on your original Dr.Cushion smart sleeping pad(s) for a full 30-night period, you may contact us via email or LIVE Chat on our website before the end of the 30-night Risk-free Trial Period to arrange for the return or one-time exchange of your purchase. The exchanged Dr.Cushion smart sleeping pad(s), controller(s), and Dr.Cushion cooler(s) are not covered by 30-night Risk-free Trial Period.

​Returns & Refunds/ Exchanges

Only the following products can be returned without return shipping charges:

  • the original Dr.Cushion smart sleeping pad(s) and controller(s) within 30 days of the original delivery date;
  • the original Dr.Cushion cooler(s) within 30 days of the original delivery date.

Otherwise, you are responsible for any return shipping fees. For the return of items that required doorstep delivery or in-home delivery, you are responsible for the return pick-up fee. For how to make a return, please contact us via email or LIVE Chat on our website. No unauthorized returns are allowed. Refunds are issued to the original method of payment within approximately 2 weeks after we receive the returned items and approve the refund, unless otherwise required by law. Unauthorized returns will be destroyed with no refund or credit given.

Only when all of the following conditions are met, the products can be exchanged without exchange shipping charges:

  • covered by a 30-night Risk-free Trial Period;
  • we are unable to repair a defect after a reasonable number of attempts.

Otherwise, you are responsible for any exchange fees (shipping and new product fees). For the return of items that required doorstep delivery or in-home delivery, you are responsible for the return pick-up fee. You may contact us via email or LIVE Chat on our website before the end of the 30-night Risk-free Trial Period to arrange for the one-time exchange of your purchase.

Worry-free Warranty & Repair

Dr.Cushion smart sleeping pad, Dr.Cushion controller and Dr.Cushion cooler are under our 1-Year Full Warranty and 4-Year Repair Service. Please read the following important terms and limitations of the warranties, including an arbitration provision that governs any disputes.

What products are covered under the Worry-free Warranty​ & Repair?

The Worry-free Warranty​ & Repair is valid only for the original purchaser from the original delivery date of the original Product purchased from Dr.Cushion, and is non-transferable. The warranties also only apply to customers who purchase the previously mentioned Dr.Cushion produtcs for personal, household, or consumer use.

Excluded from the Worry-free Warranty​​ & Repair are: (a) products purchased for, or used in, commercial settings, including, but not limited to, rental properties (e.g., Airbnb, VRBO, etc.), (b) display model products, and (c) Dr.Cushion app functionality or report, (d) sold or otherwise relinquished ownership.

What will we do under the 1-Year Full Warranty?

During the First Warranty Year, Dr.Cushion, at our sole discretion, will, within a reasonable period, repair, replace, or refund the warrantied product or part due to a defect in materials or workmanship under normal use and service. During the First Warranty Year, any covered repairs or replacement parts—and, at our sole discretion, any associated labor of our technicians, if we determine such labor is necessary—will be at no cost to you. All troubleshooting of a reported issue is done via phone, chat, email, or other supported channel when determining if your product has a defect covered by the warranties. At our discretion, if we cannot determine the cause of the reported issue, we may send a technician at no charge to you to determine how to resolve the reported issue. If your claim is covered by the 1-Year Full Warranty, we will incur both the cost of returning the warrantied product or part back to us, as well as the cost associated with the transportation, removal, or installation of the warrantied product or part. Under the 1-Year Full Warranty, if we are unable to repair a defect after a reasonable number of attempts, in our sole discretion, we may offer you the election of a replacement or refund for the product or part without charge.

Who does the 1-Year Full Warranty provide coverage to?

During the First Warranty Year, the 1-Year Full Warranty provides coverage to any consumer who owns the warrantied product and can provide proof of the original purchase date by providing either of the following pieces of information: (1) the original receipt, or (2) the original purchaser’s name, delivery address, and date of original purchase or delivery. For the purposes of the 1-Year Full Warranty, an “original purchaser” is a consumer who purchased the product directly from Dr.Cushion or an affiliate for personal, household, or consumer use.

What will we do under the 4-Year Repair Service?

After the First Warranty Year until the 5th anniversary of the original delivery date, Dr.Cushion will repair, at our sole discretion, Dr.Cushion smart sleeping pad, Dr.Cushion controller and Dr.Cushion cooler due to a defect in materials or workmanship under normal use and service, provided, however, that any repair or replacement cost of products and parts will be reached agreement between you and Dr.Cushion. You are responsible for the full cost of returning the product or part to us. This may include the cost of returning the entire product to us. Pick-up service may be available at your cost. In some cases, pick-up service at your cost may be the only option available for returning a covered product or part to us. You can contact us via email or LIVE Chat on our website if you request a repair service.

Dr.Cushion reserves the right to substitute products or parts of comparable quality and value or, where permissible by law, to use or deliver refurbished or recertified products or parts in the repair or replacement of any product or part under the 4-Year Repair Service.

Who does the 4-Year Repair Service provide coverage to?

The 4-Year Repair Service provides coverage only to those customers who owned the product on the first anniversary of the original delivery date. The 4-Year Repair Service is not transferable.

What claims are excluded from the Worry-free Warranty & Repair?

At no time will we be responsible for any incidental expenses or costs incurred by you related to or arising from warranted defects in or the performance of the product. If your claim occurs after the First Warranty Year, shipping of products or parts related to your covered warranty claim will be at your expense in both directions and the warranty will not provide coverage for the cost associated with the transportation, inspection, removal, or installation of any product or parts. After the First Warranty Year, the responsibility for the installation of any product or part replaced under the 4-Year Repair Service and any related installation costs are yours regardless of the prorated cost to you for the repaired or replaced product or part. In some instances, installation services may be available at your additional cost. The Worry-free Warranty & Repair also do not include reimbursement for inconvenience, removal, setup time, or loss of use.

The ​Worry-free Warranty & Repair exclude claims for conditions arising from normal wear and tear including but not limited to cover compression, foam compression, discoloration of parts, or normal body indentations. The ​Worry-free Warranty & Repair does not apply to a Product or part of a Product that has been serviced, altered, refurbished, or modified by anyone who is not authorized by Dr.Cushion. The Worry-free Warranty & Repair do not provide coverage for claims related to comfort preference (e.g., “The bed feels too hard/soft”). Damage caused by self-repair, using third-party parts, or from third-party repair services not authorized by Dr.Cushion is excluded hereunder and will void the Worry-free warranty & Repair. Damage caused by using the product in any manner that is inconsistent with applicable owner’s guides, user manuals, or other operational instructions or from laundering or dry-cleaning the product or any part thereof as well as damage caused by misuse or abuse including but not limited to stains, soil, burns, cuts, tears, or spills or factors other than a product defect, are also excluded hereunder and will void the Worry-free Warranty & Repair. The Worry-free Warranty & Repair do not provide coverage and will become void if damage is caused by acts of nature including but not limited to fire, flood, or lightning damage or for damage caused by power surges. Changes in barometric pressure or environmental temperature can impact the feel of your Dr.Cushion products and may require you to occasionally adjust your control system to return to your preferred setting. This is normal, is a function of the environment, and does not reflect any defect in the product. Consequently, the Worry-free Warranty & Repair will not cover claims caused by changes in barometric pressure.

Dr.Cushion products are not medical devices. They are not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease or other conditions. Dr.Cushion makes no warranties related to the diagnosis, cure, mitigation, treatment, or prevention of any disease or other condition.

What must I do to keep the Worry-free Warranty & Repair in effect?

  • Keep the original receipt. You may be asked to provide the original receipt at the time of any warranty claim. If you are unable to provide the original receipt, you may be required to provide other verification details, including the name and delivery address of the original purchaser and the date of the original purchase or delivery.
  • Keep the product in a sanitary condition. The warranties shall not apply to any product or part found to be in an unreasonably unsanitary condition. A product is in an unreasonably unsanitary condition if it is so pervasively soiled that an inspection is unable to be conducted due to the presence of body fluids, blood borne pathogens, insects, or other substances that otherwise suggest that the product has been subjected to misuse or abuse beyond ordinary wear and tear.

What are the limitations on the Worry-free Warranty & Repair?

Your exclusive remedy, in lieu of all incidental, special, or consequential damages, including for negligence, is limited to, at Dr.Cushion’s sole discretion, repair, replacement, or refund of any product or part deemed to be defective in materials or workmanship under the terms and conditions stated in the warranties.

Dr.Cushion shall not be liable in any case for incidental or consequential damages resulting from the use of this product or arising out of any breach of the warranties or any implied warranty arising by law even if it has been advised of the possibility of such damages and even if such damages are a direct result of negligence.


How does law relate to the Worry-free Warranty & Repair?

The Worry-free Warranty & Repair will be governed by the laws of the State of Washington. 
Consumers in some jurisdictions may have legal rights under applicable national legislation governing the sale of consumer goods, including, without limitation, national laws implementing EC Directive 99/44. These rights are not affected by the Worry-free Warranty & Repair.


How are disputes resolved?

In the event a dispute arises between you and Dr.Cushion arising out of this Worry-free Warranty & Repair, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). More information about the AAA is located at www.adr.org, or you can call the AAA at 1-800-778-7879. You must seek arbitration for disputes arising out of this Worry-free Warranty & Repair prior to exercising any rights or seeking any remedies created by the Title I of the Magnuson Moss Warranty Act. If you choose to pursue any rights and remedies that are not created by Title I of the Magnuson Moss Warranty Act, then arbitration is not required. Arbitration will take place in Washington. The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. If the two arbitrators cannot agree on the third arbitrator, then the AAA will appoint the third arbitrator. Barring extraordinary circumstances, the arbitrators will issue their decision within 120 days from the date the third arbitrator is selected by the two designated arbitrators or appointed by the AAA. The arbitrators may extend this time limit for an additional 30 days in the interests of justice.

All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

Payment

Dr.Cushion website supports online payment provided by Stripe. At no time will we be responsible for any issues or error incurred from Stripe side.

Promotional/ Financed Purchases

User Rules and Conduct

  • You acknowledge and agree that payment terms on purchases financed through the third-party service providers are governed by your agreement with them as the card issuer. 
  • You acknowledge and agree that available promotional financing plans change over time.
  • You acknowledge and agree that Dr.Cushion reserves the right to cancel, modify, or suspend the offer at any time without notice, even after the sale has started, at its sole discretion.
  • The Promotional/Financed Purchases are provided to you only for your personal, non-commercial use. Any unauthorized use is expressly prohibited. You are solely responsible for all acts or omissions that occur under your Account, username, or password, including any and all social media or product review content posted or submitted in connection with the Purchases.
  • You acknowledge and agree that you will not use the Purchases and the Site for any purpose that is unlawful, commercial in nature, capital, or any partisan or political advocacy activities, or prohibited by the Terms or any other agreement you have with Company.
  • You acknowledge and agree to use the Purchases in compliance with all federal, state, and local laws, statutes, ordinances, or regulations.
  • You acknowledge and agree that any product reviews you submit in connection with the Purchases comply with the Federal Trade Commission’s Guides Concerning Use of Endorsements and Testimonials in Advertising and its Trade Regulation Rule on the Use of Consumer Reviews and Testimonials.
  • You acknowledge and agree that you will not take any action or upload, post, submit, or otherwise distribute or facilitate the distribution of any content in connection with the Purchases through the Site, social media platform, product review portal, or any other electronic or digital communication platform in any manner that: 
    1. Is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, invasive of another’s privacy, tortious, obscene, profane, or which otherwise violates these Terms;
    2. Infringes any copyright, patent, trademark, trade secret, or other proprietary rights, or rights of publicity or privacy of another natural person, entity or organization, or other third party;
    3. Makes any reference to another natural person by their full name or by including any information about such natural person that they could be identified by name, entity or organization, or other third party (including Company competitors), including their website, mailing or service address, email address, or phone number;
    4. Company deems as or that it may reasonably consider to be defamatory, hateful, racially or religiously biased or offensive, unlawfully threatening, or unlawfully harassing to any natural person, entity or organization, or other third party;
    5. Constitutes unauthorized or unsolicited advertising, junk or bulk e-mail distribution such as spamming, chain letters, or any form of lottery or gambling;
    6. Imposes an unreasonable or disproportionately large load on Company’s computing, storage, or communications infrastructure, or that attempts to gain unauthorized access to the Purchases, other Accounts, computer systems, or networks connected to the Purchases, through password mining or otherwise;
    7. Contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit, or interfere with the proper function of any software, hardware, or network system or to damage or obtain unauthorized access to any system, data, or other information of Company or any third party;
    8. Creates Dr.Cushion accounts by any automated means or under false or misleading pretenses;
    9. Harvests, scrapes, or collects any information from the Purchases or the Site;
    10. Disguises the source of your content posted by you; or
    11. Impersonates any person or entity, including any employee or representative of Company.

  • You acknowledge and agree that you have not received compensation or any consideration from another natural person, entity or organization, or other third party (including Company competitors) for any and all content or product reviews posted or submitted in connection with the Purchases.
  • You acknowledge and agree that Company may immediately suspend or terminate your access to the Purchases at its sole discretion should Company deem your use of the Purchases to fail or appear to fail to comply with any provision of these Terms.

Terms & Conditions Updates

We reserve the right to change the Terms & Conditions at any time, so we encourage you to review it periodically. The “Last Updated” legend at the bottom of this page indicates when this Terms & Conditions was last revised. We will provide notice to you if these changes are material and, when required by applicable law, we will obtain your consent. We may provide this notice by email to you, by posting notice of such changes on our sites or applications, or by other means, consistent with applicable law and the content of the changes.
